Minutes of November 1, 2007 workshop unanimously approved as amended, motion by D. Webster, second by P. Velie.
Agent’s report:
Enforcement action: 68 Stony Brook Road, property abuts Belmont Country Club (BCC). All trees along the stream on BCC land have been removed as proven by photos. BCC wants to replant the strip along the stream and is taking action against the homeowner who had vegetation removed. Irrigation system installed without notice to CC. Kelly Cardoza as BCC rep to decide on action. Homeowner Diarbakerli seems to understand CC requirements for any further work. M Trudeau will send letter to BCC encouraging prompt reply and swift resolution.
Rock Meadow WHIP Program: soil tests report soil overly acidic, possible effect of invasives, liming required, possibly two applications two years apart. Chris Polatin is investigating.
Correspondence file passed around for CC to check.
Invoice/payment for Rock Meadow work: redesigned contract resigned to facilitate payment. Work to date costs just under $17,000 for Chris Polatin/Bruce Scherer. Will be using Town Meeting appropriated funds until reimbursed.
Rock Meadow site visit planned by Debbie Hartman for Tuesday November 13 at 10 AM for all parties involved.
Bruce Westgate: Victory Gardens Reported on financial status, now to be handled by Town.
He is willing to continue as garden coordinator without financial responsibilities. Ideas for expenditures: signage for entrance to garden. Bruce will present a proposal for the sign. Further requests: a weed whacker to help edge the gardens and couple of wheelbarrows. A brush hog is being purchased from the Rails/Trails grant. Other items might come from Garden surplus funds. Previously treated ailanthus will be removed in winter when ground frozen.
Rock Meadow Subcommittee: Chair N. Davis gave update on November 1, 2007 meeting. John Maguranis is looking for letter of support from CC for enforcement. N.Davis will draft letter.
145 Brookside Avenue: hearing opened at 7:40 PM Notice of Intent submitted by David Loveluck to replace existing deck with larger deck, within the 100 ft buffer zone/first 100 feet of Riverfront of Beaver Brook. Wetlands have been delineated. Project is 30 and 33 feet from flagged bank and BVW, outside of the 25 ft no disturb zone. CQA suggested as appropriate treated wood post material. Erosion controls at discretion of agent, to be determined at site visit. CC recommended removal of existing asphalt pad under proposed deck with applicant returning for minor modification of Order if this is too expensive. Conditions in addition to standard list: remove impervious asphalt between deck and bulkhead, aprox 4ft x 8ft, hand dig postholes, straw bale erosion controls may be installed at
discretion of agent at site visit. Very little vegetation remains along bank so applicant is willing to install 6 native woody shrubs within ten feet of the bank. No motorized vehicles allowed without erosion controls. M Moore moved to approve orders as described, N Davis second. Unanimous approval. Hearing closed 7:55PM.

End of Athletic field is in 100 ft buffer zone. Topsoil to be removed, artificial turf system installed using existing drainage system from 2001 that drains to Town storm drain system. End zone nearest resource area to be paved in impervious track material equaling 7000 sq ft including 2000 sq ft in buffer zone with runoff directed to perimeter trench drains. 2001 planned 10,000 gallon irrigation tank turned out to be too expensive to use, and may not have been constructed. Artificial turf is pervious and will drain into system of 10 inch drain to storm drain, existing pipe under the existing
field. Surface generally guaranteed for 8 years. Some infiltration occurs through the base of the drain pipes system.
Two six thousand gallon underground tanks from 3 wells exist on campus for irrigation, about 700 feet in depth.
Conditions in addition to standard list include: Banded siltsock in manhole to catch silt before the town storm system. Before removing siltsock monitor it for sediment. Sample outflow in manhole for TSS standards (NPDES) and respond with BMPs (Best Management Practices) Sample first flush in first hour of one half inch storm event per quarter. If TSS over 30 ppm, install BMPS. No work closer than 25 ft to resource area. Straw bales for erosion control. Consider opportunities for groundwater infiltration.. Julie Vondrak, Epsilon Associates: offering three alternatives for Compensatory Flood Storage/Wildlife Habitat replication.
Commissioners expressed concerns on many issues: restricted v. unrestricted hydraulic connections, natural flow direction on site, figures on and determination of high ground water v seasonal high groundwater levels, quantity and quality of point source discharge, questions re. location, size and functioning of infiltration chambers, soil removal; citing inaccuracies, gaps, inadequate information., questions efficacy of Stormceptor system, size, location and backup of sewer storage system, effectiveness of bio-filter strip relative to width, snow storage and plantings to name a few.
D. Albrecht agrees construction is close to groundwater and is not submitting construction documents including the geotechnical information on drains. Groundwater would be sump pumped into drainage system: detention or infiltration system, but no information submitted on capacity of systems.
Attorney Michael Leon hand submitted recent document announcing intent to close hearing. M. Trudeau stated CC policy is to receive hard copy and enough copies for Commissioners,
S.Horsley repeatedly requested groundwater elevation data as per the graph from D.Albrecht, graph released and circulated. Groundwater data useful, clay layer may cause fluctuations. Total Suspended Solids (TSS) removal determined by weight of removed particles.
D. Webster issued extensive list of requests for detailed information. Other comments were submitted by P. Velie, C. Bishop, T. Lichauco, M Moore. N Davis expressed concerns verbally..

CC decision: CC requests additional information and permission to continue the hearing.
Applicants left room to discuss the decision, returned and agreed to the extension for one month only. Comment letter to applicant to be emailed by the 13th with hard copies in the mail. Attorney Leon :stated next hearing will be the last so this will be the final submittal. Order of Conditions will reference the plans. Claims NoI doesn’t need to be modified and is not part of the Order of Conditions.
At 11:55 PM, hearing continued with permission of the applicant until Tuesday December 4 2007 at 7:30 PM.
Chapter 91: Martha Moore. If DEP considers Chapter 91 applicable, does this affect CC decision? The 4-5 ft x 100ft long strip, former course of Little River is not impacted by the project.

S.Horsley repeatedly requested groundwater elevation data as per the graph from D.Albrecht, graph released and circulated. Groundwater data useful, clay layer may cause fluctuations. Total Suspended Solids (TSS) removal determined by weight of removed particles.
D. Webster issued extensive list of requests for detailed information. Other comments were submitted by P. Velie, C. Bishop, T. Lichauco, M Moore. N Davis expressed concerns verbally..
M Trudeau indicated information required for CC to effectively supervise work.

Ellen Mass: FAR Summarized information on value of property to wildlife.
Richard Longmire: spoke of sewage backups, concern about 50,000 gallon tank in high ground water. Observes high water table after just a half inch of rain and has seen water flow backwards into the pond once a month.
Stanley Dzierzesky: Chapter 91 comments due to DEP by Nov 9
CC decision: CC requests additional information and permission to continue the hearing.
Applicants left room to discuss the decision, returned and agreed to the extension for one month only. Comment letter to applicant to be emailed by the 13th with hard copies in the mail. Attorney Leon :stated next hearing will be the last so this will be the final submittal. Order of Conditions will reference the plans. Claims NoI doesn’t need to be modified and is not part of the Order of Conditions.
At 11:55 PM, hearing continued with permission of the applicant until Tuesday December 4 2007 at 7:30 PM.
Chapter 91: Martha Moore. If DEP considers Chapter 91 applicable, does this affect CC decision? The 4-5 ft x 100ft long strip, former course of Little River is not impacted by the project.
Compiled comments/questions of Commissioners to be refined and resubmitted for inclusion in document requesting final information/clarification, prepared for Applicant by M Trudeau by November 13th. CC to make notes of possible Conditions for the Order.
Workshop scheduled for Wednesday November 28 at 5 PM to discuss responses from applicant.
